These Terms & Conditions govern your use of the Crown Exchange website and services. Crown Exchange is a marketplace operated by 1839 Exchange. By accessing or using Crown Exchange, you agree to be bound by these Terms & Conditions.

Please read these Terms carefully before using the website, creating an account, listing a Rolex, or purchasing a Rolex through Crown Exchange.

1. INTRODUCTION & ACCEPTANCE OF TERMS

1.1 These Terms & Conditions ("Terms") apply to your use of the Crown Exchange website, marketplace and related services ("Crown Exchange", "we", "us" or "our"), which are operated by 1839 Exchange.

1.2 Crown Exchange is the trading name, brand and marketplace operated by 1839 Exchange.

1.3 By accessing the website, creating an account, submitting a listing, contacting a seller or purchasing a watch through Crown Exchange, you confirm that you have read, understood and agree to these Terms.

1.4 If you do not agree to these Terms, you should not use Crown Exchange.

1.5 Additional terms may apply to specific services, including our Seller Terms, Listing Rules, Returns & Refunds Policy and Privacy Policy. Where applicable, those terms form part of these Terms.

2. DEFINITIONS

For the purposes of these Terms:

"Buyer" means a person purchasing or seeking to purchase a watch listed on Crown Exchange.

"Seller" means a person or business listing a watch for sale through Crown Exchange.

"Dealer" means a professional watch dealer or business using Crown Exchange to list watches.

"Private Seller" means an individual selling a watch in a private capacity rather than as part of a business.

"Listing" means a watch advertised for sale on Crown Exchange.

"Watch" means a Rolex watch listed through Crown Exchange.

"Transaction" means a sale or proposed sale of a Watch between a Buyer and Seller.

"Website" means the Crown Exchange website and any associated digital services operated by or on behalf of 1839 Exchange.

"1839 Exchange" means the company that owns and/or operates the Crown Exchange marketplace and associated services.

3. ABOUT CROWN EXCHANGE

3.1 Crown Exchange is a specialist marketplace focused exclusively on Rolex watches and is operated by 1839 Exchange.

3.2 Unless expressly stated otherwise, Crown Exchange does not own the watches displayed on the Website and is not the seller of those watches.

3.3 Sellers are responsible for the watches they list, including their ownership, authenticity, condition, description, availability and their ability to complete a sale.

3.4 Unless otherwise expressly stated, the contract for the sale of a Watch is between the Buyer and Seller.

3.5 Crown Exchange provides a platform through which Buyers and Sellers can discover, communicate about and arrange transactions involving Watches.

3.6 Crown Exchange does not guarantee that any Watch will sell, that a Seller will complete a transaction, or that a Buyer will complete a purchase.

3.7 We may provide additional services in connection with a transaction. Where we do so, the relevant terms will be explained to the Buyer and/or Seller.

4. ELIGIBILITY & ACCOUNT REGISTRATION

4.1 You must provide accurate, complete and current information when creating an account or using Crown Exchange.

4.2 You must not create an account using false information or impersonate another person or business.

4.3 You are responsible for keeping your account information and login credentials secure.

4.4 You must notify us if you believe your account has been accessed or used without your permission.

4.5 We reserve the right to refuse registration, suspend an account or terminate an account where we reasonably believe that these Terms have been breached or that the account presents a risk to Crown Exchange, 1839 Exchange, its users or the integrity of the marketplace.

5. BUYING A ROLEX

5.1 Watches displayed on Crown Exchange are offered by individual Sellers or Dealers.

5.2 Buyers should carefully review the Listing, photographs, description, condition, specifications, price and any accompanying documentation before proceeding with a purchase.

5.3 Crown Exchange does not guarantee that every detail contained within a Listing is accurate unless we have expressly verified that information.

5.4 Buyers are responsible for satisfying themselves as to the suitability of a Watch before purchasing.

5.5 A Listing may be withdrawn, amended or become unavailable at any time before a sale is completed.

5.6 The price displayed on a Listing is the price specified by the Seller unless otherwise stated.

5.7 Buyers must not attempt to purchase a Watch using false information, fraudulent payment details or for an unlawful purpose.

6. SELLING / LISTING A ROLEX

6.1 Sellers must only list Watches that they are legally entitled to sell.

6.2 Sellers must provide accurate and complete information about every Watch they list.

6.3 Sellers must accurately disclose, where applicable:

  • Reference number

  • Model

  • Year or approximate year

  • Condition

  • Dial

  • Bracelet

  • Movement

  • Box and papers

  • Service history

  • Replacement or aftermarket components

  • Known damage or defects

  • Any other information that could reasonably affect a Buyer's decision

6.4 Sellers must not knowingly provide misleading photographs, descriptions or information.

6.5 Sellers must not list counterfeit, stolen or unlawfully obtained Watches.

6.6 Sellers remain responsible for the accuracy of their Listings and for completing transactions with Buyers.

6.7 Crown Exchange reserves the right to request additional information, documentation or verification before approving or continuing a Listing.

6.8 We may remove or reject a Listing where we reasonably believe it breaches these Terms, our Listing Rules or applicable law.

7. DEALER LISTINGS

7.1 Dealers may use Crown Exchange in accordance with the Dealer terms applicable to their account.

7.2 Dealers must provide accurate business and contact information.

7.3 Dealers are responsible for ensuring that their Listings comply with applicable consumer protection and trading laws.

7.4 Dealers must ensure that all Watches advertised are available for sale and accurately described.

7.5 Dealers are responsible for fulfilling their legal obligations to Buyers, including any applicable consumer rights, warranties and return rights.

7.6 Crown Exchange reserves the right to suspend or terminate a Dealer account where the Dealer repeatedly breaches these Terms or provides inaccurate, misleading or unlawful Listings.

8. PRIVATE SELLER LISTINGS

8.1 Private Sellers must provide accurate information regarding the Watch and their identity where requested.

8.2 Private Sellers must only list Watches they have the legal right to sell.

8.3 Private Sellers must disclose known faults, modifications, replacement components and other material information about the Watch.

8.4 Crown Exchange may request identification, ownership information, photographs, documentation or other information before allowing a Listing to remain active.

8.5 Private Sellers must not represent themselves as professional dealers if they are not acting in that capacity.

9. AUTHENTICITY & CONDITION

9.1 Authenticity is a fundamental requirement of every Watch listed on Crown Exchange.

9.2 Sellers are responsible for ensuring that Watches they list are genuine and accurately described.

9.3 Sellers must disclose any known non-original, aftermarket, replacement or modified components where relevant.

9.4 Listings must not describe a Watch as original, authentic, unrestored, unpolished or otherwise in a particular condition where the Seller does not have reasonable grounds for making that representation.

9.5 Crown Exchange may request additional photographs, documentation or other evidence relating to the authenticity or condition of a Watch.

9.6 Where Crown Exchange has reasonable concerns regarding authenticity, ownership or accuracy, we may suspend or remove the Listing pending further investigation.

9.7 Buyers should understand that photographs and descriptions cannot always establish every aspect of a Watch's condition or authenticity.

9.8 Where appropriate, Buyers should obtain independent professional advice or inspection before completing a purchase.

10. PRICES & FEES

10.1 Crown Exchange may offer different listing and membership options from time to time.

10.2 Current options may include:

Free Listing
No upfront listing fee, subject to the applicable selling commission.

£99 Listing
A one-off £99 listing fee with no percentage-based selling commission, subject to the applicable terms.

Featured Listing
A £149 fee for the applicable Featured period, with the Watch subsequently moving to the standard catalogue where applicable.

Dealer Membership
A £99 monthly subscription for eligible Dealers, subject to the applicable Dealer terms.

10.3 The applicable price and fee will be displayed before the relevant service is purchased.

10.4 Fees are payable in accordance with the payment method and timing specified by Crown Exchange.

10.5 Unless otherwise stated, fees relate to the Crown Exchange service and do not represent a guarantee that a Watch will sell.

10.6 We reserve the right to change our fees and pricing structures. Changes will not retrospectively alter fees already paid unless required by law.

11. FEATURED LISTINGS

11.1 Sellers may have the option to purchase Featured placement for eligible Listings.

11.2 Featured placement is intended to provide increased visibility within Crown Exchange.

11.3 Featured placement does not guarantee enquiries, offers or a sale.

11.4 The duration and price of Featured placement will be displayed when the service is purchased.

11.5 At the end of the Featured period, the Listing may move to the standard catalogue in accordance with the applicable service.

11.6 Crown Exchange reserves the right to remove a Featured Listing where the Listing breaches these Terms or applicable law.

12. PAYMENTS & TRANSACTIONS

12.1 The parties responsible for payment, delivery and completion of a transaction will depend on the transaction method used.

12.2 Where Crown Exchange facilitates or processes any part of a payment, additional terms may apply.

12.3 Buyers must use valid and authorised payment methods.

12.4 Sellers must provide accurate payment and transaction information where required.

12.5 Crown Exchange may delay, restrict or cancel a transaction where we reasonably suspect fraud, unlawful activity, misrepresentation or other prohibited conduct.

12.6 Buyers and Sellers must not use Crown Exchange to facilitate fraudulent or unlawful transactions.

12.7 Any applicable payment processing, banking, currency conversion or other third-party charges will be dealt with in accordance with the relevant payment terms.

13. DELIVERY & COLLECTION

13.1 Responsibility for delivery or collection will depend on the arrangements agreed between the Buyer and Seller.

13.2 Sellers are responsible for ensuring that Watches are securely packaged and appropriately insured where they are responsible for shipping.

13.3 Buyers should ensure that delivery arrangements, insurance and responsibility for loss or damage are clearly agreed before completing a transaction.

13.4 International Buyers and Sellers are responsible for applicable customs duties, import taxes and other charges unless otherwise agreed.

13.5 Crown Exchange is not responsible for delays caused by postal services, couriers, customs authorities or other third parties, except where applicable law provides otherwise.

14. RETURNS, REFUNDS & CANCELLATIONS

14.1 Returns, refunds and cancellation rights depend on whether the Seller is a Dealer or Private Seller and on the circumstances of the transaction.

14.2 Where a Dealer sells to a consumer, the Dealer remains responsible for complying with applicable consumer protection legislation.

14.3 Private sales may be subject to different legal rights and obligations.

14.4 Buyers should review the applicable Returns & Refunds Policy before completing a purchase.

14.5 Where Crown Exchange processes a refund, the timing and method of the refund will depend on the circumstances and payment method used.

14.6 Nothing in these Terms limits or excludes any statutory consumer rights that cannot lawfully be limited or excluded.

15. USER CONTENT & LISTINGS

15.1 Sellers retain responsibility for the content they submit to Crown Exchange.

15.2 By submitting photographs, descriptions and other content, you grant 1839 Exchange and Crown Exchange a non-exclusive, worldwide licence to use, reproduce, display and distribute that content for the purpose of operating, promoting and marketing Crown Exchange and the relevant Listing.

15.3 You confirm that you have the necessary rights to submit such content.

15.4 You must not submit content that is unlawful, misleading, defamatory, infringing, fraudulent or otherwise inappropriate.

15.5 Crown Exchange may remove content that breaches these Terms or that we reasonably believe may create legal, reputational or operational risk.

16. PROHIBITED ACTIVITIES

Users must not use Crown Exchange to:

  • List counterfeit or stolen Watches

  • Misrepresent a Watch

  • Provide false documentation

  • Engage in fraudulent activity

  • Circumvent Crown Exchange fees

  • Misuse another user's account

  • Harass or threaten another user

  • Scrape or systematically copy Crown Exchange content without permission

  • Conduct unlawful transactions

  • Upload malicious software or harmful material

  • Attempt to interfere with the operation or security of the Website

  • Use Crown Exchange for any purpose prohibited by applicable law

We reserve the right to remove Listings, suspend accounts and take other appropriate action where prohibited activity is suspected or identified.

17. COMMUNICATION BETWEEN BUYERS & SELLERS

17.1 Crown Exchange may provide communication tools or contact mechanisms to allow Buyers and Sellers to communicate.

17.2 Users must communicate honestly and respectfully.

17.3 Users must not use Crown Exchange communication tools to conduct fraudulent, abusive or unlawful activity.

17.4 Crown Exchange may restrict or remove access to communication services where necessary to protect users or the integrity of the marketplace.

18. INTELLECTUAL PROPERTY

18.1 All intellectual property rights in Crown Exchange, including its branding, logo, Website design, software, content and database, belong to 1839 Exchange, Crown Exchange or their respective licensors unless otherwise stated.

18.2 You may use the Website for its intended purpose but may not copy, reproduce, distribute, modify or commercially exploit Crown Exchange content without permission.

18.3 Nothing in these Terms transfers ownership of Crown Exchange or 1839 Exchange intellectual property to any user.

19. ROLEX TRADEMARK & BRAND DISCLAIMER

19.1 Rolex and associated names, trademarks and intellectual property belong to their respective rights holders.

19.2 Crown Exchange is an independent marketplace operated by 1839 Exchange and is not owned, operated, sponsored, endorsed or authorised by Rolex unless expressly stated otherwise.

19.3 References to Rolex on Crown Exchange are made for the purpose of identifying and describing the Watches offered through the marketplace.

19.4 Nothing on Crown Exchange should be interpreted as suggesting an affiliation, partnership or endorsement by Rolex unless expressly stated.

20. WEBSITE AVAILABILITY & ACCURACY

20.1 We aim to keep Crown Exchange available and operating correctly but do not guarantee that the Website will always be available, uninterrupted or error-free.

20.2 We may temporarily suspend Website access for maintenance, upgrades, security or other operational reasons.

20.3 We do not guarantee that all information displayed on the Website will always be complete, current or error-free.

20.4 We may correct errors, update information or amend Listings where appropriate.

20.5 We reserve the right to modify, suspend or discontinue parts of Crown Exchange where reasonably necessary.

21. SUSPENSION & TERMINATION

21.1 We may suspend or terminate an account or remove a Listing where we reasonably believe that:

  • These Terms have been breached;

  • Information provided is false or misleading;

  • A Watch may be counterfeit, stolen or unlawfully obtained;

  • Fraudulent activity is suspected;

  • The account presents a security or legal risk; or

  • Continued access would otherwise be inappropriate or unlawful.

21.2 We may also remove Listings that are no longer available or do not comply with Crown Exchange requirements.

21.3 Suspension or termination does not remove any rights or obligations that arose before the suspension or termination.

22. LIMITATION OF LIABILITY

22.1 Nothing in these Terms excludes or limits liability where doing so would be unlawful.

22.2 Crown Exchange is a marketplace operated by 1839 Exchange and, unless expressly stated otherwise, is not responsible for the acts or omissions of Buyers or Sellers.

22.3 To the extent permitted by law, Crown Exchange and 1839 Exchange are not responsible for losses arising from transactions between Buyers and Sellers, including losses caused by a Seller's failure to deliver a Watch or a Buyer's failure to complete a purchase.

22.4 We are not responsible for indirect or consequential losses to the extent that such liability may lawfully be excluded.

22.5 Nothing in this section affects statutory rights that cannot legally be excluded or limited.

23. INDEMNITY

23.1 To the extent permitted by law, you agree to compensate 1839 Exchange and Crown Exchange for losses, claims, liabilities, costs or expenses arising from your unlawful use of the Website, your breach of these Terms, or your infringement of another person's rights.

23.2 This provision does not apply to the extent that the relevant loss has been caused by 1839 Exchange's own unlawful conduct or negligence where liability cannot legally be excluded.

24. COMPLAINTS & DISPUTES

24.1 If you have a complaint relating to Crown Exchange, please contact us using the details provided on the Website.

24.2 Where a complaint relates to a transaction between a Buyer and Seller, Crown Exchange may assist in communicating with the relevant parties but is not necessarily a party to that transaction.

24.3 We may request relevant information from Buyers and Sellers to assist with resolving a marketplace dispute.

24.4 Crown Exchange does not guarantee that every dispute between a Buyer and Seller can be resolved by us.

25. PRIVACY & DATA PROTECTION

25.1 Crown Exchange collects and processes personal information in accordance with its Privacy Policy.

25.2 By using Crown Exchange, you acknowledge that your personal information may be processed for the purposes described in our Privacy Policy.

25.3 Where Buyers and Sellers exchange personal information in connection with a transaction, each party is responsible for using that information lawfully and appropriately.

26. CHANGES TO THESE TERMS

26.1 We may update these Terms from time to time.

26.2 The latest version will be made available on the Crown Exchange Website.

26.3 Where appropriate, we may notify registered users of material changes.

26.4 Your continued use of Crown Exchange after updated Terms take effect constitutes acceptance of the revised Terms.

27. GOVERNING LAW & JURISDICTION

27.1 These Terms are governed by the laws of England and Wales, unless applicable law requires otherwise.

27.2 Subject to any mandatory consumer rights, the courts of England and Wales shall have jurisdiction over disputes arising in connection with these Terms.

27.3 Nothing in this section removes any mandatory rights a consumer may have under the laws applicable to them.
